Terms and Conditions for Consignment



Introduction



ATTENTION: These Terms and Conditions constitute an agreement for consignment services (the "Agreement") provided by NYC Fashion Revival LLC (the "Company") to you (the "Client"). Please read the terms and conditions contained below as they form part of a legally binding contract you will be entering into if you choose to have your item(s) consigned to the Company.



The Company offers the Client a chance to purchase items from our NYC Fashion Revival LLC website. By placing an order with our Company, the Client accepts these Terms and Conditions.



About The Company

NYC Fashion Revival LLC is registered with the State of New York. The Company can be contacted by email at info@nycfashionrevival.com.



1.The Agreement

The Agreement shall consist of only these Terms and Conditions. The Agreement shall only be entered into and come into effect once the the Client places an order with our company. The Client will pay for the total amount of the item, tax, and shipping cost. The client understands that it will take at least 1 business day to process the order and the Client will not chargeback for the delay of shipment. When client receives the package, the client is responsible to check the package and the item inside of the package before signing the acceptance of the package. Client will be fully responsible for the damage of the item causing by the shipping carrier if the client didn’t inspect the package before signing. The client will have 3 days starting from the date of delivery date stated on the tracking number of the shipping carrier’s website to make a return request with our company. The date which we received the email of return request will be considered the official date of the return request file. The company tag must be intact when sending back the item. If the tag is removed, our company will not accept the return and will not refund the client. If the return request is filed with our company within 3 days of delivery date, the client is responsible to ship the item back immediately. If our company does not receive back the returned item, we will not refund the client. If the item is received, our company will inspect and authenticate the condition and authenticity of the item to check if this is the same item that is being returned in the same condition. A refund will be issued after the returned item is fully inspected and authenticated and the refund will be deducted for the shipping costs and a flat rate handling fee of $50.



2. Services Offered

The Company is to provide a platform for the client to purchase pre-owned designer goods from our website. The client read and agree to the Terms and Conditions when the client places an order with our company.



3. Cost for Services Offered

The client will pay for the total amount of the item purchased. This amount includes the item cost, tax, and shipping cost. There will be a flat rate of $50 handling fee is a return is requested. Full amount of money will be deducted if the item is returned as counterfeit.



4. Client's Obligations & Acknowledgments

The Client will be obligated to pay for the total amount of the item purchased. This amount includes the item cost, tax, and shipping cost. There will be a flat rate of $25 handling fee is a return is requested. Full amount of money will be deducted if the item is returned as counterfeit.

The Client acknowledges that placing an order with our company the clients is entitled to pay the full amount of the purchase.



5. Refunds

For buying from our NYC Fashion Revival LLC website, we will issue refund back to the original payment method. Please note that we will deduct the shipping costs from the refund and a handling fee of $25 per item and this rule applies to both refund method (store credit/original payment method). The return period is 3 day starting the date of delivery date stated on the tracking number of the shipping carrier's website. 

*Please make sure the tag is intact when you send the item back. Once the tag is removed, we will not accept the return.



6. Company Liability

The Company shall not be liable for any deficiency including but not limited to any omissions, mistakes, erroneous attributions, authenticity issues in the consignment as a consequence of external circumstances, circumstances regarding the item(s) being authenticated, the Client failing to provide full and accurate information, and by any other factor that cannot be identified by a reasonable inspection of the photographs and other information received from the Client.



7. Agreement Termination

The Agreement shall be terminated if the Company fail to respond on a quote within the time frame noted above or in any other way breech this Agreement. The Client, is entitled to terminate this Agreement with the Company in writing.



8. Indemnification

The Client Shall indemnify the Company and its authenticators, employees and officers against all liabilities and expenses incurred by them as a result of any breach of this agreement of arising from related claims by third parties in connection with the consignment service provided.



Should the Client breach this Agreement by using the consignment quote for prohibited or illegal purposes, 1) the Agreement shall be terminated with immediate effect and the Client shall not be entitled to any refund, 2) the company's license to the consign shall be revoked, and 3) the Client shall destroy the consignment quote. There shall be no further liability of the Company to the Client from the date of termination of the Agreement.



9. Severance

In the event that any part of the Agreement should be held to be unenforceable for any reason, that term shall be deemed to be not part of the Agreement, the remaining portions of the Agreement shall remain in full force and effect.



10. Force Majeure

Neither party shall be liable in damages or have the right to terminate this agreement for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including but not limited to acts of God (such as but not limited to fires, explosions, earthquakes, drought, title waves and floods); wars or hostilities, insurrections, revolutions, civil war, invasions, or acts of enemies (whether war be declared or not); riots, strikes, lock-outs or disorder; acts or threats of terrorism; and/or any other cause beyond the reasonable control of the party whose performance is affected (including mechanical, electronic, or communications failure).



11. Acceptable Use Policy

You are solely responsible for complying with all applicable laws in all of your actions related to your use of NYC Fashion Revival LLC authentication services, regardless of the purpose of the use.



12. Warranties


The authentication is provided to you on an “as is” basis without any warranties of any kind. The company and the staffs performing the authentication and inspection on the item being sold, to the fullest extent permitted by law, disclaim all warranties with regard to the authentication and inspection, including without limitation, the warranty of merchantability. The company and its staffs make no warranties about the accuracy, reliability, completeness, or timeliness of the authentication, inspection, and selling process. You also agree that your sole and exclusive remedy for our preparation of the authentication, inspection and selling process will be your contractual right to a return of the fees you paid to us for the services.



13.Ship and Return Goods

Shipping

Free Shipping to all orders with NYC Fashion Revival LLC collections.

All orders will required 2-3 business processing days before the item is shipped. 

We will use USPS priority mails for all shipments. Direct Signature and Insurance will be added to the shipments. 

 

Return

When our clients buys from our NYC Fashion Revival LLC, we will process the orders within 1 business day and ship the item the next business day. We will then provide a tracking number to our clients. 

In case of a return, customers have 3 days beginning the date of delivery to submit a return request to us. If the customers submit a return request within 3 days of delivery date, we will issue a refund after we receive the item back to the original payment method.  

Our company do not accept return request after 3 day of delivery. Please also note that the customer is responsible for the $25 restocking fee and the actual cost of the return shipping label (if requested). when the customer make a return request. We will refund the amount back to the customer after taking off the $25 handling fee and the actual cost of the return shipping label (if requested). We will send a shipping label (if requested) via email to the customer to send the item back, or you may ship your return or exchange via any other shipping method of your choice to the address indicated below. However, should you choose not to use the label provided to you and ship via your own carrier, NYC Fashion Revival cannot be held responsible for packages lost in transit, and shipping costs will not be reimbursed.

Please make sure the tag is intact when you send the item back. Once the tag is removed, we will not accept the return.

Introduction

1.The Agreement

The Agreement shall consist of only these Terms and Conditions. The Agreement shall only be entered into and come into effect once the Company and the Client accept the quote, the Client will ship the consigned item(s) to the Company and the Client will be consigning the item(s) for 90 days after and the begin date of consignment period will be notified by the Company.



2. Services Offered

The Company aims to review and accept quotes within 2 business days after the Client has submitted their request and/or after the Client has responded to the requests for additional information, if any, whichever occurs later. While the Company’s goal is to respond a quote within 2 business days during the Company’s business hours, such is not always possible to do so. If this period of 2 business days are exceeded, the Company shall not be obligated to issue a refund. In the same respect, it is the client's responsibility to respond all quotes and requests in a timely manner. All photos and information needed for consignment must be submitted within 7 days from the date the quote is submitted.



3. Cost for Services Offered

There will not be a fee for consigning with the Company, and however, the Client will be charged for shipping cost if the item is seriously different than described and/or the item is not authentic. The Company reserves the right to revise prices at any time.



4. Client's Obligations & Acknowledgments

The Client will be obligated to pay for the shipping cost if an item is seriously not as described or the item is not authentic. The Client is acknowledge on the authenticity and the condition of the item(s) the Client wants to consign. The Client has authenticated the item with the Company or a third party reputable authentication service before quoting for consignment.

The Client acknowledges that the consigned price the Company accepts or offers is based on the Company’s knowledge of the market resale value. Thus, the Client should not, in any forms, seek a refund or compensation for items that do not sell. The Client is aware that there is a chance that the item(s) the Client consigns will not be sold.



5. Refunds

The Company will not refund the Client in any ways.



6. Company Liability

The Company shall not be liable for any deficiency including but not limited to any omissions, mistakes, erroneous attributions, authenticity issues in the consignment as a consequence of external circumstances, circumstances regarding the item(s) being authenticated, the Client failing to provide full and accurate information, and by any other factor that cannot be identified by a reasonable inspection of the photographs and other information received from the Client.



7. Agreement Termination

The Agreement shall be terminated if the Company fail to respond on a quote within the time frame noted above or in any other way breech this Agreement. The Client, is entitled to terminate this Agreement with the Company in writing.



8. Indemnification

The Client Shall indemnify the Company and its authenticators, employees and officers against all liabilities and expenses incurred by them as a result of any breach of this agreement of arising from related claims by third parties in connection with the consignment service provided.



Should the Client breach this Agreement by using the consignment quote for prohibited or illegal purposes, 1) the Agreement shall be terminated with immediate effect and the Client shall not be entitled to any refund, 2) the company's license to the consign shall be revoked, and 3) the Client shall destroy the consignment quote. There shall be no further liability of the Company to the Client from the date of termination of the Agreement.



9. Severance

In the event that any part of the Agreement should be held to be unenforceable for any reason, that term shall be deemed to be not part of the Agreement, the remaining portions of the Agreement shall remain in full force and effect.



10. Force Majeure

Neither party shall be liable in damages or have the right to terminate this agreement for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including but not limited to acts of God (such as but not limited to fires, explosions, earthquakes, drought, title waves and floods); wars or hostilities, insurrections, revolutions, civil war, invasions, or acts of enemies (whether war be declared or not); riots, strikes, lock-outs or disorder; acts or threats of terrorism; and/or any other cause beyond the reasonable control of the party whose performance is affected (including mechanical, electronic, or communications failure).



11. Acceptable Use Policy

You are solely responsible for complying with all applicable laws in all of your actions related to your use of NYC Fashion Revival LLC authentication services, regardless of the purpose of the use.



12. Warranties

The authentication is provided to you on an “as is” basis without any warranties of any kind. The company and the staffs performing the authentication and inspection on the item being sold, to the fullest extent permitted by law, disclaim all warranties with regard to the authentication and inspection, including without limitation, the warranty of merchantability. The company and its staffs make no warranties about the accuracy, reliability, completeness, or timeliness of the authentication, inspection, and selling process. You also agree that your sole and exclusive remedy for our preparation of the authentication, inspection and selling process will be your contractual right to a return of the fees you paid to us for the services.



13.Ship and Return Goods

The Client is agreed to ship an authentic and inspected item(s) to the Company. The Company is not responsible for any lost or damage of item(s). The Client should seek the delivery carrier for further information on the delivery of the package(s). The Company is and will return the same item(s) the Client ship to the Company. The Client understands that there may be signs of wear occur on the item(s) due to handling and photographing of item(s) for consignment. If an item is claimed not authentic after the Company receives the item(s), the Client agrees to pay both ways of shipping to the Company.

Please read the terms and conditions contained below as they form part of a legally binding contract you will be entering into if you choose to have your item(s) sold to the Company.



The Company offers the Client a chance to sell an items that the Client owns to our store. By submitting a quote to the Company for selling an item to our company, the Client accepts these Terms and Conditions.

Terms and Conditions for Instant Authentication:


Introduction



ATTENTION: These Terms and Conditions constitute an agreement for authentication services (the "Agreement") provided by NYC Fashion Revival LLC (the "Company") to you (the "Client"). Please read the terms and conditions contained below as they form part of a legally binding contract you will be entering into if you choose to have your item(s) authenticated by the Company.



The Company offers the Client a chance to find out the authenticity of their item(s) through the use of an online authentications of an item that either the Client owns or the Client intend to purchase. By submitting the photographs of the item(s) the Client would like to be authenticated, the Client accepts these Terms and Conditions.

1.The Agreement

The Agreement shall consist of only these Terms and Conditions. The Agreement shall only be entered into and come into effect once the Company has accepted to make a authentication of the item(s) and the Client has paid a flat rate of authentication service fee of $25 subject to the Company's right to withdraw its services in accordance with the terms.



2. Services Offered

The Company aims to provide the authentication of submitted items within 1 hours during business hours after the Client has submitted their request and/or after the Client has responded to the authenticators requests for additional information, if any, whichever occurs later. While the Company's goal is to respond within 1 hour during the Company’s business hours, such is not always possible to do so. If this period of 1 hour during business hours is exceeded, the Company shall not be obligated to issue a refund. In the same respect, it is the client's responsibility to submit photographs in a timely manner. All photos and information needed for authentication must be submitted within 7 days from the date the order was placed.



3. Cost for Services Offered

The flat rate of authentication fee of $25 will be the cost for the Company’s authentication services. If the service fee is changed, the Client will seek an update price from the Company through email or the Company’s website for the latest service fee. The Company reserves the right to revise prices at any time.



4. Client's Obligations & Acknowledgments

The Client shall pay the authentication fee for the authentication to the Company. The Client shall provide clear and accurate photos and provide full and accurate information about the item(s) for more accurate authentication result.

The Client acknowledges that authentication of pre-owned luxury item(s) is based on the knowledge and opinions of the authenticators such result as to authenticity may differ. Unless otherwise stated in writing, the authentication result will only consider as an opinion and the best knowledge of the authenticators that can be provided. The Client is welcome to seek a second opinion if the result of authentication is disagreed.



6. Client Grants Company Rights

Although the result of authentication email belongs to the Client, Client should not disclose the contents for any commercial or other uses other than acknowledgement on the item’s authenticity. Client can black-out any personal information but is not allowed to make any changes on the email of the result of authentication.



7. Refunds

The Company will refund the authentication fee to the Client if the Company is unable to perform the authentication service after the Client has submitted all the required photos and information.

The Company Will not refund or partially refund authentication fee due to the fact that the outcome of the authentication result is not satisfied by the Client. The Company will not refund or partially refund the Client because the Client cannot provide additional required photos or information within seven (7) days of request. The authentication service request will be abandoned if the Client does not submitted all required information and photos 7 days after additional photos and information request is sent.



8. Company Liability

The Company shall not be liable for any deficiency including but not limited to any omissions, mistakes, erroneous attributions, authenticity issues in the authentication as a consequence of external circumstances, circumstances regarding the item(s) being authenticated, the Client failing to provide full and accurate information, and by any other factor that cannot be identified by a reasonable inspection of the photographs and other information received from the Client.



9.The Use of The Authentication Result

The Company will only provide an authentication result through emails. The Client will receive an email regarding to the authenticity of the item(s) the Client submitted. The Client shall not use the result of authentication from the Company, in any forms, to file a claim and/or open a case against the seller of the item(s) authenticated, the person(s) who provide, give, or sell the item(s) to the Client, and/or any organization(s) or any companies that will investigate or issue refund for the result of the item’s authenticity. The result of authenticity is only an acknowledgement to the Client for the authenticity of the item(s).



10. Agreement Termination

The Agreement shall be terminated if the Company fail to perform authentication within the time frame noted above or in any other way breech this Agreement. The Client, is entitled to terminate this Agreement with the Company in writing, and will be refunded the authentication service fee paid. The refund shall be credited to the Client by the same means through which the Client paid the Company.

The Client Shall indemnify the Company and its authenticators, employees and officers against all liabilities and expenses incurred by them as a result of any breach of this agreement of arising from related claims by third parties in connection with the authentication service provided.



Should the Client breach this Agreement by using the authentication for prohibited or illegal purposes, 1) the Agreement shall be terminated with immediate effect and the Client shall not be entitled to a refund on the price paid for the authentication, 2) the company's license to the authentication shall be revoked, and 3) the Client shall destroy the authentication.
